Indian government completed the draft rules under the Digital Personal Data Protection Act 2023 and plans to release them for public consultation in mid-August, according to the Economic Times. The DPDP act is anticipated to be notified following the conclusion of the current Parliament session.
A senior government official revealed that the government is planning to have an extensive consultation on the rules. Hence, it will be available in public after the law is passed in the parliament to ensure the Act provides robust grounds for citizens to protect their privacy.
The DPDP Act classifies under-18 users as children and mandates social media platforms and other online services to obtain parental consent before processing minorsโ data. This provision sparked debate, as industry leaders expressed concern about privacy implications and how practical is to verify usersโ age accurately.
Another ET resource said that the parental consent and issue of age verification remains. For that, officials are in conversations with industry stakeholders and experts. Whereas a few of the solutions are proposed, they are under observation.
The IT ministry went through broad consultations with representatives of internet companies and social media intermediaries to discover possible solutions for age-gating and following methods of age verification of children, such as virtual Aadhaar IDs, QR codes, Digi-Locker, and app store-level verification. However, striking a balance between safeguarding childrenโs privacy and thwarting frivolous complaints is challenging.
The act is a required step for the country, in the dimension of data safeguard and privacy rights. In this crucial stage, the act is garnering feedback and gearing for the implementation. Post the implementation process, the impacts and effects will be visibly seen.
